Welcome to the October 2024 Customer Update from eDiscovery Assistant! 

This is the first iteration of our customer update to come to you each month with the latest happenings at eDiscovery Assistant. Each month will give you insights into new content and changes that have been added, as well as feature improvements, and new features. This month’s update is longer because it’s the first, so future months will be shorter. 🙂


Feature Updates

Search Improvements

We’ve made quite a few improvements to our Search functionality over the last few months, some of which is unique to what we want to search for in ediscovery. We put together this video to walk you through the updates to proximity search, section search, both of which will allow you to drill down even further into case law. 

Search Order on Cite Lists

We’ve added a filter on Cite Lists to allow you to sort the cases on your cite list in ascending or descending order so you can see the most recent cases first or put them in reverse chronological order to see the progression of thought by the courts. The default order has been modified to descending so you’ll see the most recent decisions first. Not using cite lists yet?  This quick video will show you how to use them to manage your research.

Dynamic Cite Lists (Team and Enterprise Plans only)

Dynamic Cite Lists keeps you apprised when a new decision is added to the database that matches your search criteria. Set up a dynamic cite list using any criteria you choose – by judge, jurisdiction, date range, issues or search terms – and receive an email notification when a new case is added to your cite list. The cases remain on the cite list as well.

Content Updates

New Issue Tag!  

We’ve added a new issue tag for Generative AI. This issue identifies when the use of Generative AI is at issue in a case law decision or an order from a specific judge or court that requires counsel to disclose whether they have used generative AI tools in documents submitted to the court, and if so, how and which tools were used, and in some cases, what verification was done to preclude hallucinations.

Case Law

  • As of October 22, 2024 we’ve added more than 4000 decisions so far in 2024!  Thirty two of those decisions have been featured on our Case of the Week series. You should be receiving the weekly case law newsletter with the Case of the Week. If you are not seeing it, you can sign up here to receive it. As of late September, Case of the Week is now available as a podcast on your favorite podcasting platform including Apple Podcasts, Spotify, and more. 
  • Included in those decisions is ABA Formal Opinion 512 – Generative Artificial Intelligence Tools, tagged with Gen AI.

Rules 

  • At least 30 judges across the country have issued orders regarding Generative AI, use of those tools and the required disclosures and ethical requirements. A complete list of those orders is here, including a link to the order in eDiscovery Assistant  and will continue to be updated as new orders are entered. Each of the orders has been added to that jurisdiction’s rules for review. 
  • The New International Rules Category includes content from overseas, beginning with the UK Disclosure Rules. Next up include the EU AI Act and GDPR. If you have specific international jurisdictions you’d like to see included here, please send us an email or drop a chat in the app. 
  • American Arbitration Association. The various section rules for the AAA have been added as a new category under Rules for easy

Glossary Terms

  • We’ve partnered with Legaltech News to include The Artificial Intelligence Glossary, providing access to more than 65 key terms you need to know and understand when discussing AI.
  • Additional terms added include GDPR, Wayback Machine, and EU AI Act.

Academy

  • New International Module!
    • We’ve begun adding content from overseas. Our new International Module now includes articles on the UK Disclosure process from Fiona Campbell, Head of Electronic Disclosure at Field Fisher, and FAQ’s on the new EU AI Act that went into effect on August 1, 2024 from Jonathan Armstrong at Punter Southall. 
  • Webinar on Hyperlinked Files
    • This webinar from August 27, 2024 reviews the current legal and technological challenges with preserving, collecting and producing hyperlinked files in ediscovery. Users can download the slide deck from the Resources section.
  • New in Sources of ESI
    • 5th Circuit Rejects Judicial Notice of Wayback Machine
      • Brett Vennis of Jones Walker discusses a recent decision from the 5th Circuit Court of Appeals in rejecting a request from counsel to take judicial notice of pages from the Wayback Machine where the pages at issue detail the terms and conditions of an online auction that are at the core of the parties’ dispute.

User Generated Content for Academy

Our team will review  your submission and notify you of acceptance for inclusion. Please note that you must have the authority to republish the article before we can include it in Academy. 

Security Updates

2FA

Beginning August 1, 2024, eDiscovery Assistant rolled out two factor authentication (2FA) for all users. 2FA is currently tied to receiving a code via email, and we are evaluating the need to add 2FA via text message and use of the Authenticator app. If you have any input on the use of any of these methods, please let us know by dropping a note in chat in eDiscovery Assistant, or emailing us at support@ediscoveryassistant.com.

Session Timeouts

Beginning the middle of November, we will be implementing session timeouts after 90 minutes of inactivity when you are logged into the platform. You will receive a pop-up notification indicating that you have been inactive for 90 minutes and asking if you want to continue staying logged in. If you respond within 2 minutes, you can remain logged in, or the system will log you out. You will have to reactivate your 2FA when you are logged out of the platform. Please note: the home page for Academy is public, so while you may be logged out of your view, you will remain on the Academy home page when the session concludes.
